When you place an order, you are making an offer to purchase products from Zaid Group.

We reserve the right to accept, decline, limit, or cancel an order where reasonably necessary, including in cases involving product availability, pricing errors, suspected fraud, payment issues, supplier availability, shipping restrictions, or other legitimate business reasons.

An order is not considered accepted until payment has been successfully processed and we have confirmed the order.

Please review your order carefully before submitting it. We may be unable to accommodate cancellation requests after an order has been processed, entered fulfillment, or shipped.

If we cancel or materially modify an order, we will make reasonable efforts to contact you using the email address, billing address, shipping address, or telephone number provided with the order.

Returns, refunds, and exchanges are governed by our Return and Refund Policy, which is available through our online store.

Prices, discounts, promotions, and product availability may change without notice.

The price charged for a product will be the price displayed at the time your order is placed, subject to correction of obvious errors.

SECTION 5 - SHIPPING AND DELIVERY

Delivery times provided by Zaid Group are estimates and are not guaranteed.

Shipping and delivery times may vary depending on the product, destination, supplier, fulfillment location, courier, customs processing, weather, holidays, incorrect address information, or other circumstances outside our reasonable control.

Products within the same order may occasionally be fulfilled from different locations and may arrive in separate shipments.

Where tracking information is available, it will generally be provided after the relevant shipment has been dispatched.

Customers are responsible for providing a complete and accurate shipping address. Please contact us as soon as possible if you identify an address error.

If an order is lost, damaged, incorrect, or significantly delayed in transit, please contact us so we can review the situation and assist with an appropriate resolution.

International customers may be responsible for customs duties, import taxes, brokerage charges, or other government-imposed fees unless otherwise stated at checkout.

Unless expressly permitted, you may not reproduce, distribute, modify, republish, publicly display, transmit, store, commercially exploit, or create derivative works from protected materials without permission from the relevant rights holder.

Nothing in these Terms grants you a licence or ownership interest in any intellectual property belonging to Zaid Group, Shopify, or any third party except as expressly stated.

The name ZAIDBEEN and associated branding are proprietary brand assets associated with Zaid Group and may not be used without authorization.

Shopify's trademarks, logos, product names, and service names belong to Shopify or its applicable rights holders.

Other third-party names, trademarks, logos, and product names displayed through the Services remain the property of their respective owners.

SECTION 7 - OPTIONAL TOOLS

We may provide access to tools, features, or services supplied by third parties.

We may not monitor or control all such third-party tools.

Where permitted by law, access to optional third-party tools may be provided on an "as is" and "as available" basis.

Your use of optional third-party tools is at your own discretion and may also be subject to the third party's own terms, policies, and conditions.

We may introduce new tools, functionality, or resources from time to time. Such features may also form part of the Services and be subject to these Terms.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Zaid Group is powered by Shopify, which enables us to provide the Services to you.

However, purchases made through our store are transactions made directly with Zaid Group.

By using the Services, you acknowledge that Shopify is the ecommerce technology provider and is not the seller of products purchased from Zaid Group.

To the extent permitted by applicable law, Shopify is not responsible for obligations arising solely from sales between you and Zaid Group.

SECTION 10 - PRIVACY POLICY

Personal information collected through the Services is handled in accordance with our Privacy Policy, which is available through our online store.

Certain personal information may also be collected or processed by Shopify in connection with Shopify's provision and operation of the ecommerce platform.

Shopify's privacy practices are governed by Shopify's applicable privacy policy.

Because the Services are hosted by Shopify, information submitted through the Services may be processed by Shopify and other service providers, including providers located outside your country of residence, as necessary to operate the store, process orders, provide payments, prevent fraud, fulfill orders, and provide related services.

We may remove or moderate Feedback where reasonably necessary.

We are not obligated to compensate you for voluntarily submitted Feedback unless otherwise expressly agreed.

Agents must not conceal their automated nature where identification is reasonably required.

14.3

We may limit, restrict, or technically control whether and how Agents access or interact with our Services.

14.4

Agents must comply with applicable technical requirements, security restrictions, access controls, and applicable law.

Agents must not circumvent CAPTCHAs, authentication systems, security protections, robot exclusions, or other measures designed to control automated access.

SECTION 15 - TERMINATION

We may suspend or terminate access to the Services where permitted by law, including where these Terms are materially violated, fraudulent activity is suspected, security is threatened, or continued access may harm Zaid Group, customers, Shopify, or third parties.

You remain responsible for amounts properly due before termination.

Any provisions that by their nature should survive termination will continue to apply, including provisions regarding intellectual property, liability, indemnification, governing law, privacy, and other continuing obligations.

SECTION 16 - DISCLAIMER OF WARRANTIES

Information provided through the Services is made available for general commercial and product-information purposes.

While we make reasonable efforts to provide accurate information, we do not guarantee that all information will always be complete, current, uninterrupted, or error-free.

To the fullest extent permitted by applicable law, and subject to any statutory rights that cannot legally be excluded, the Services and products are provided without additional warranties beyond those expressly stated by Zaid Group or required by law.

Nothing in these Terms excludes or limits warranties, guarantees, remedies, or consumer rights that cannot legally be excluded under applicable law.

To the fullest extent permitted by applicable law, Zaid Group and its affiliates, officers, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services or products purchased through the Services where such liability may legally be limited.

This may include loss of profits, loss of revenue, loss of data, or similar consequential losses.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable consumer protection or other laws.

SECTION 18 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Zaid Group and its affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, or reasonable costs arising directly from:

(a) your material breach of these Terms;

(b) your violation of applicable law;

(d) unlawful misuse of the Services.

We will provide reasonable notice of an indemnifiable claim where appropriate and may participate in or control the defence of the claim where permitted by law.

SECTION 19 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent where such consent may lawfully be required.

Zaid Group may transfer or assign its rights and obligations in connection with a legitimate transfer, restructuring, sale, or operation of its business, subject to applicable law.

SECTION 22 - GOVERNING LAW

These Terms of Service and any separate agreements through which we provide the Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.

Subject to any rights that cannot legally be excluded, you and Zaid Group agree to submit to the jurisdiction of the courts located in Ontario, Canada.

Headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

SECTION 24 - CHANGES TO TERMS OF SERVICE

You may review the current version of these Terms through our online store.

We may update or replace portions of these Terms from time to time.

The updated Terms will become effective on the date stated in the applicable notice or when published, as permitted by law.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms, subject to applicable law.
